A patent is an exclusive and sole right given to the inventor who used his / her idea to develop product or process with patentable subject matter, utility, novelty, non-obviousness and enablement. The primary purpose of the patent is to prevent any person or organization from misusing the patented ideas or process. Patent registration also cover inventions such as methods or processes of manufacture patentable.
INVENTIONS NOT PATENTABLE
- which is frivolous, the mere arrangement or re-arrangement or duplication of known devices each functioning independently of one another in a known way,
- any process for the medicinal, surgical, curative, prophylactic diagnostic, therapeutic or other treatment of human beings or any process for a similar treatment of animals to render them free of disease or to increase their economic value or that of their products,
- a mathematical or business method or a computer programme per se or algorithms, a literary, dramatic, musical or artistic work or any other aesthetic creation whatsoever including cinematographic works and television productions,
- a mere scheme or rule or method of performing mental act or method of playing game, a presentation of information, topography of integrated circuits, an invention which in effect, is traditional knowledge or which is an aggregation or duplication of known properties of traditionally known component or components, etc.
No suit shall be brought for any infringement of a patent granted under this section committed before the actual date on which such patent was granted. However passing off
Infringement of registered patent include an injunction subject to such terms and at the option of the registered patent owner, either damages or an account of profits or the goods which are found to be infringing and materials and implements, the predominant use of which is in the creation of infringing goods shall be seized, forfeited or destroyed without payment of any compensation.
Registered Patent protection is granted for a 20 years from the filing date of the application.
